Beware the buyer! Read the fine print!!
I noticed a few people sign and proceed without even reading the documents.
I decided to take a seat & read it through. Basically, it protected the "service provider" against every conceivable eventuality. It was all acceptable though and when I was about 3/4 through, I almost stopped reading to sign. Then I saw,
10.2 Unless prohibited by law, the customer agrees to hold ******** harmless for any loss or damage caused to the customer arising from the ******* service and or ******* not being able to perform the ******* service for any reason, including *******s negligence, or due to any malfunction of the equipment or the network.
So I said that we could go ahead if they removed that clause. They refused, so I left.
They effectively safeguard themselves against ANY claim whatsoever. Many people just pay and think that they are completely safe.
Take the time to read the fine print & don't accept the unreasonable.
When will we ever learn our lesson? Most of us are inclined to sign without reading the fine print. Ons is te goedgelowig en te ordentlik.
At most of the better electronic places you can get a cellsecure type of transponder which when fitted to your vehicle alarm system and your vehicle electronics, or fuel pump system, will send you an SMS.
You then have the device cell number which you can then 'phone and it will shut the vehicle down.
The thief does not have the time to look for this device, as it could be fitted anywhere in the vehicle.
The fitting should be done using proper automative wire resembling all the wiring in your vehicle, as apposed to ordinary flex wire which is easy to spot if left open.
This should more than satisfy your insurance company, especially if demonstrated to them.
There is also a system, that if you tramp brakes, these lock and the vehicle remains there until you come and reverse the action, probably with a hidden switch and solenoid. Would love this system if anyone knows it, because then you cannot even tow the vehicle away.
I think that someone has mentioned this on the forum before. I heard about it in Cape Town about six years ago.
The tracking company did remove that clause from my contract when I told them that I pay once off for three years.
They change the things if you do it big.
They sent a person from PTA to Nelspruit to fit the system.
They do have an installer in Nelspruit but I know the people and know their work and was not happy let them do the work due to previous experience.
So they can change it.
But a good thing to read the contract before.
The insurance gave me R100 off per month due to the tracker.
Tx
When they tried to claim their considerable expenses from the tracking guys, they used this very clause to escape all damages.
The insurance company ended up paying.
Tom, my previous Ranger had a tracker which I removed myself due to certain reasons and what I found was quite horrifying regarding the fitment (wiring) of the tracker.
If only I could understand all the english on the contract.
RD, I will phone you to translate it to me into afrikaans next time I need to sign a contract.
The school board paid my school fees back for the english subject. Die boertjie sukkel maar om al daardie engels te verstaan.
If fitted by humans, mistakes will occur. It will also be known to unwelcome customers where it is fitted. That is "in my small mind" why I think the companies put certain clauses into contracts. It is all about protecting themselves not to say it will happen, but if it happens. Before I let people work or install something on or in my vehicle I observe how the working area is looking and how they treat other people's vehicles. Why would they treat me different?
